Will my Tivo upgrade to v3.1?

Had to restore my original 2.5.x image on my T-60 as my drive went bad. This unit has turbonet and a dead modem. The unit comes up, however it wants to do the Final Step and dialout, which it can't due to the dead modem. I've ran the turbonet install but can't get the call to run. Is it because the unit on initial setup will always try to go out the modem? Will my unit download v3.1 via the sat or does it have to confirm I am a Tivo subscriber first?
I have another T-60 which has 3.1 on it, can I just back up the OS on that one and restore on this one?

Yes, take the image from the other TiVo. You have to do a 'clear and delete everything' reset once the image is on this TiVo, and remember not to connect the satellite feeds until after you've done Guided Setup.

I backed up my v3.x unit and restored but the unit I restored to, does Welcome Powering up, then almost there, then reboots. Sat cables are not connected.

Do you need to delete /tvbin/modemtest to avoid the broken modem?

Already do that, as I lost modems in both units last November. In the past if I had forgotten to rename the modemtest, it just hung on Almost there. It never would do a spontaneous reboot as I'm seeing now. One thing I am confused on as it's been almost 8 months since I did this last and they were both v2.5.x then, is do I have to do the tivoflash from the turbonet install? I know with v3.x I do not have to do any software driver updates but unsure on the tivoflash procedure.
Thing I should do another restore in case this one got hosed?
