Is this just a case of deja vu or was there a TV show recently that had a story almost exactly like this? I could've sworn I watched this story on TV. Not good... my mind is having a hard time separating TV from reality. :confused:

San Francisco -- A 14-year-old boy injured by a piece of gum-wrapper foil that struck his eye has sued the Walnut Creek school district and the two brothers convicted in the schoolroom attack.

The lawsuit, filed in Contra Costa Superior Court on Tuesday, seeks unspecified damages for Nicholas Trainer and his mother. Trainer suffered permanent damage to his eye when he was hit by the sharp wad blown from the mouth of 13-year-old Jeffrey Figueroa.

The lawsuit claims school officials knew Jeffrey and his brother, Stephen Figueroa, were bullies and troublemakers but failed to control their behavior. In June, Jeffrey was sentenced to three weekends in Juvenile Hall, while his brother was convicted of misdemeanor battery.

I remember seeing this story on the Today Show severl months ago. Maybe that's what you were remembering?
