CNBC Poll goes like this:

Lead in :

The company’s claim that the Janet Jackson incident was the most watched moment ever on the device is raising concerns.


Just how did digital video recorder company TiVo (TIVO, news, msgs) know how many people were replaying the Janet Jackson Super Bowl incident? That’s what’s worrying some TiVo owners.

Some TiVo owners are concerned the company is able to track what they are watching. But the company said that while it does gather data, it strips out any information that could be traced back to an individual viewer, CNET.com reported.Your money, fast.

Answer choices:
An effective marketing tool
An invasion of privacy


I conted that These choices skew the answers to "an invasion of privacy"
That is why I created this poll. Thoe a poll here is also no a sample of the general public but of tivo users so it may go the other way"

I wrote an email to the poll creaters. See below:

I saw your poll on tivo. I very much desagree with the choice of answers you have provided. The answers are "An effective marketing tool" or "An invasion of privacy". With the question provided "TiVo's ability to monitor customer viewing habits is" there should be either a no or yes answer to the poll. People who dont think that it is a good marketing tool are more likly to answer that it is an ivasion of privacy. Even people who dont agree about an invasion of privacy. As a result you have skewed many people to the other answer. Neither of the answers provided represnt my opinion of ... it is NOT an invasion of privacy but not a good marketing tool. You have created a very biased poll and this is a very iresposible thing to have doen. You should remove the poll and reissue it. I hope this is not representitive of your other polls. If it is, you have lost credibility in this viewers eye.

It says right in the manual that you can opt out.

If you choose to opt out, your privacy isn't invaded. If you choose not to opt out, your privacy is not invaded.

Nothing to see here, really.

Well, since they don't have any idea what I watch (just what a bunch of people in my zip code watch, if they decide to not opt out), it can hardly be an invasion of my privacy.

Maybe, but it seems worse this year, perhaps fueled by the JJ thing and articles from know-nothing reporters. Plus there are more TiVo subscribers than ever.

On the other hand, they say there's no such thing as bad publicity, although I don't think Martha Stewart would agree.

Another factor is most Tivo users are Direct TV custormers who may (if they are like me) have never even set up a Tivo on their own. I've been paying for the service for months by the time I found out what they are doing without asking.

Apparently other people are reading about this too since the CNET story
"TiVo watchers uneasy after post-Super Bowl reports" is listed as their most popular headline of the week.
